Terms and Conditions
1. Definitions
1.1. Purchase and sale conditions and rules – responsibilities of the parties to the distance purchase or sale agreement, which establishes the obligations and rights of the Buyer and the Seller in purchasing the products and services and payment terms for them, delivery (if the products are shipped) and return and other provisions related to the purchase / sale of products and services performed on the website www.motiko.lt.
1.2. Seller – Motiko
1.3. Buyer – 1) a person who has reached the age of majority in accordance with the laws of the Republic of Lithuania, whose capacity is not restricted by court order; 2) a legal person; 3) duly authorized representatives of all the above persons.
1.4. Personal data – Buyer’s name, surname, telephone number, e-mail address.
2. General provisions
2.1. The Terms and Conditions are a binding legal document for both parties, it sets out the rights and obligations of the Buyer and the Seller, delivery and return procedures, conditions of purchase and payment of products, parties’ liability and other possible conditions related to the purchase / sale of products and services on the inert site – motiko.lt .
2.2. The seller reserves the right to change, supplement or amend the rules at any time. Buyers are informed about changes, corrections or additions to the rules on the website motiko.lt. Buyers must read these rules before purchasing a product / service. The new rules and amendments and additions to the rules shall enter into force upon their publication on the motiko.lt page with the note “Amendment of the Rules” and the date of the amendment of the rules.
2.3. Only those Buyers who comply with Clause 1.3 of the Rules have the right to purchase products and services from the motiko.lt website. By registering and purchasing products and services, the Buyer confirms that he meets the requirements of clause 1.3. The Seller reserves the right to ask the Buyer to confirm the personal data in case of uncertainty.
2.4. The Seller has the right not to sell the products and / or suspend the provision of the service without the Buyer’s approval of the requirements specified in clause 1.3.
3. Protection of personal data
3.1. When purchasing products and services from motiko.lt, the Buyer agrees that his / her name, e-mail address, telephone number will be processed by motiko.lt for the purposes of direct marketing and activity analysis.
3.2. If the Buyer does not wish that in accordance with 3.1. If the data is processed, the Buyer must not tick the box “I agree with the motiko.lt purchase and sale rules”. If the Buyer no longer wants his data to be used for direct marketing purposes, the Buyer must inform the Seller by e-mail.
3.3. The Seller confirms that the Personal Data provided by the Buyer will be processed only for the purposes of selling products and services at motiko.lt, and for the purposes of direct marketing and analysis. The Seller undertakes not to disclose the Buyer’s personal data to third parties except for the following cases:
3.3.1. when executing an order or providing other services – to the Seller’s partners providing delivery of products or other services ordered by the Buyer;
3.3.2. law enforcement institutions in accordance with the procedure provided for in the legal acts of the Republic of Lithuania;
3.3.3. if it is necessary to prevent or investigate criminal offenses.
3.4. The buyer has the following rights:
3.4.1. Be informed about the processing of your Personal Data.
3.4.2. Get acquainted with the Personal Data you have provided and know how it is processed.
3.4.3. To receive information to whom and for what purpose his / her Personal Data is processed, to whom it was provided.
3.4.4. Require the rectification or destruction of your Personal Data and the suspension of the processing of Personal Data.
3.4.5. Do not consent to the processing of his / her Personal Data.
3.5. By purchasing products and services on the motiko.lt website, the Buyer agrees that the Seller has the right to store his data on the server indefinitely, for all legitimate purposes to store Personal Data.
3.6. The Buyer’s identity document submitted to the Seller, an employee of the Lithuanian Post or an employee of the courier service and the data contained therein are used only for identification and identification.
3.8 The Buyer must submit a written request or instruction related to the processing of Personal Data by sending an e-mail to: info@motiko.lt. The Seller must provide a written e-mail response to the Buyer and the actions specified in the request or instruction or to answer why they are refused.
4. Ordering products, the moment of establishing the legal relationship of purchase and sale
4.1. When ordering products or services from the motiko.lt website, the Buyer must indicate in the information fields provided by the Seller the appropriate information for ordering the products: name, surname, delivery address, telephone number and e-mail address. The buyer agrees that the information and notifications necessary for the execution of orders for products should be sent to him by e-mail or SMS. The Buyer agrees that a part of the Buyer’s Personal Data would be transferred to the Seller’s partners (data processors) in order to properly execute the order and provide the service properly.
4.2. After the Buyer selects the product or service and forms the shopping cart and confirms it by performing all the steps of the order, it is considered that a purchase-sale agreement and legal purchase-sale relationship has been concluded between the Buyer and the Seller.
4.3. The buyer is informed by e-mail or SMS when all order steps have been completed correctly.
4.5. Buyer’s orders are stored in the motiko.lt database.
5. Buyer’s rights
5.1. The Buyer has the right to purchase products and services on the motiko.lt website in accordance with the procedure established by the Rules.
5.2. The Buyer has the right to refuse the ordered products and services in accordance with the Rules.
5.3. The Buyer has the right to return the products and services in accordance with the procedure established by the Rules.
5.4. The Buyer has other rights set forth in these Rules.
6. Buyer’s obligations
6.1. When purchasing products and using motiko.lt services, the Buyer undertakes to comply with these Rules, other conditions clearly indicated on the website – motiko.lt, and not to violate the legal acts of the Republic of Lithuania.
6.2. By registering or purchasing products and services on the website motiko.lt, the Buyer undertakes to ensure that the information provided and Personal Data are not incorrect or incorrect.
6.3. If the Buyer’s data changes in the registration and purchase form, the Buyer must inform the Seller by e-mail: info@motiko.lt.
6.4. The buyer must pay for the ordered products and services within the specified period.
6.5. When buying food, the buyer confirms that he is familiar with the composition of the products and buys the products at the risk of side effects. In the event of allergic or other unpleasant side effects, the seller does not take responsibility for the units and cannot be held responsible for the health condition of the customer.
7. Seller’s Rights
7.1. The Seller reserves the right to suspend or change the functions, layout, terminate or adjust the functions of the website motiko.lt.
7.2. The Seller reserves the right to suspend or terminate the services provided on the motiko.lt website.
7.4. The seller reserves the right to change the scope, method, provision of services, prices of services and products available – motiko.lt.
7.4. If the Buyer tries to damage the stability and information security of the website motiko.lt, the Seller has the right to immediately, without prior notice suspend, limit or cancel the Buyer’s user and the Buyer’s actions, as well as the possibility to use the website – motiko.lt.
8. Obligations of the Seller
8.1. The Seller undertakes to provide services and products in accordance with the terms and conditions provided for in the Rules, to provide the Buyer with an opportunity to purchase and use the services and products provided by motiko.lt.
8.2. The Seller undertakes to process the Buyer’s Personal Data in accordance with the procedure provided for in the legal acts of the Republic of Lithuania and the provisions specified in Clause 3 of the Rules.
8.3. Inform the Buyer about the Rules 7.1. – the changes made to points 7.4.
8.4. The Seller undertakes to deliver the products and services ordered by the Buyer to the address indicated by him or by the intended method of delivery of the service in accordance with the rules of the “Terms of Delivery of Products”.
8.5. The Seller undertakes to accept the products and services returned by the Buyer in accordance with the provisions specified in the “Conditions for Return of Products and Services”.
9. Exchange of information
9.1. The Seller shall send all notifications in accordance with the procedure provided for in Rules 3.2 to the contact information specified by the Buyer.
9.2. In case of questions or solving the problem, the Buyer sends notifications to the contacts indicated on the Seller’s “Contacts” page.
10. Final provisions
10.1. These rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
10.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these Rules.
10.3. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached within 20 (twenty) calendar days, disputes shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
Conditions for Return of Products and Services
1. Refund of products
1.1. We provide a 100% money back guarantee if the product or service is canceled due to the fault of motiko.lt. The money will be refunded upon submission of a written request to you to info@motiko.lt by e-mail, within 2 working days from the receipt of the request and the end of the processing of the request.
2. Terms of return of products
2.1. Deficiencies of the sold products are eliminated, the products are replaced and returned in accordance with the Government of the Republic of Lithuania Regulation 2001. June 11 by resolution no. 697 approved Retail Rules and other valid legal acts of the Republic of Lithuania.
2.2. According to the purchase and sale rules, in order to return the product, the buyer must send an inquiry by e-mail – enter his e-mail and list the reasons why he wants to return the product.
2.3. The costs of sending / delivering the products when the Buyer sends the products to the Seller to be returned or replaced due to the identified defects or defects of the products shall be paid by the Seller in case the returned defects or defects in the shipped products are returned. If no defects or defects are found in the products, the costs of shipping shall be paid by the Buyer.
2.4. When sending the products to the Buyer in the case specified in Clause 2.1 of the Purchase and Sale Rules, the following conditions must be observed:
2.4.1. it is desirable, but not obligatory, that the returned products be in the original, undamaged packaging;
2.4.2. the returned products must be in the same configuration as ordered and received by the Buyer; sets that have been the subject of a joint bid cannot be split;
2.4.3. the returned products must be unused, undamaged, unaltered physical form or composition of the products, clean and tidy;
2.4.4. the returned item must be with all original labels;
2.4.5. a written request is submitted stating the wish to change the product to a quality product, to correct defects and shortcomings of the product, to return the money paid by the Buyer;
2.4.6. a document confirming the purchase of the products (cash receipt, invoice, document confirming the acceptance of the products, e-mail confirming the order) is submitted.
2.5. The Buyer has the right to withdraw from the concluded contract within fourteen days, without giving a reason and without incurring costs other than those provided for in Article 6.22811 of the Civil Code, except for the exceptions provided for in Article 6.22810 (2) of the Civil Code.
2.6. The Buyer’s right to withdraw from the concluded sales contract does not apply to the following contracts: service contracts, according to which the services and products are provided to the Buyer as such – as specified when purchasing on the motiko.lt website; contracts for individual production of products manufactured in accordance with the Buyer’s special instructions, which are not pre-manufactured and which are manufactured taking into account the Buyer’s personal choice or instruction; contracts for perishable products with a short duration; contracts for packaged products which have been unpacked after delivery and which are ineligible for return for health or hygiene reasons.
2.7. By agreeing to these rules, the Buyer also confirms that he understands that the categories of products specified in Clause 2.6 of the Purchase and Sale Rules also include cosmetics, i. y. The Seller does not grant the Buyer the right to withdraw from the contract concluded for these products without giving a reason.
2.8. The withdrawal period expires after fourteen days: in the case of a sales contract, from the date on which the Buyer or a person specified by the Buyer, other than the carrier, receives the ordered products or: if the Buyer has ordered more than one products and delivered separately, from the date on which the Buyer or a person specified by the Buyer, other than the carrier, receives the last products; if the products are delivered in different lots or parts, from the day when the Buyer or the person specified by the Buyer, except for the carrier, receives the last lot or part.
2.9. The Seller must return to the Buyer all amounts paid by the Buyer, including the delivery costs paid by the Buyer, no later than within fourteen calendar days from the Buyer’s notice of withdrawal. The full amount is returned to the account specified by the Buyer via the selected money transfer method. In cases when the products delivered to the Buyer fall into the categories specified in Clause 2.6 of the Purchase and Sale Rules, the delivery fee shall not be refunded to the Buyer.
2.10. The Seller is not obliged to reimburse the Buyer for additional costs incurred by the Buyer choosing a method other than the cheapest usual delivery method offered by the Seller.
2.11. The Seller may not refund the amounts paid by the Buyer until the products have been returned to the Seller or until the Buyer provides proof that the products have been sent to the Seller.
2.12. The Buyer must send the products to the Seller or his authorized person no later than within fourteen days from the notification of the withdrawal from the contract and the return of the products or services. When the Buyer implements the withdrawal, the Buyer bears the costs of returning the products directly.
2.13. When the Buyer exercises the right to withdraw from the concluded contract, additional contracts are automatically terminated at no cost to the Buyer, except for the costs provided for in Articles 6.22811 and 6.22812 of the Civil Code. Ancillary contracts are contracts under which the Buyer acquires products or services related to the concluded contract, and those products or services are provided by the Seller or another person in accordance with the agreement with the Seller.
Terms of Delivery of Products
1. Delivery
1.1. When the buyer orders products on the website – motiko.lt, the buyer chooses the delivery method. When ordering products, the buyer must fill in the necessary data required to perform the service properly. If the data is filled in incorrectly due to the Buyer’s fault – the Buyer assumes full responsibility for the non-delivery of the products. The products are delivered in the territory of the Republic of Lithuania. For delivery to other countries, the Buyer can contact by e-mail info@motiko.lt
1.2.The Buyer undertakes to accept the ordered products according to the pick-up method chosen by him. If the Buyer does not take back the products according to the method chosen by him and without informing the Seller about it, the Buyer has no right to make claims to the Seller. Upon return of the products to the address of the sender of the products for re-dispatch of the products, the Buyer must contact the Seller according to the specified contact details.
1.3. The Seller undertakes to deliver the products to the Buyer within the terms specified in the descriptions of the products. These terms do not apply in cases when the Seller does not have the required or alternative products in stock and the Buyer is informed about the shortage of the products ordered by him. The Buyer agrees that in case of unforeseen circumstances beyond the control of the Seller, the delivery term of the products may differ from the terms specified in the descriptions of the products or the delivery term discussed by the Buyer and the Seller. In case of unforeseen circumstances, the Seller undertakes to immediately contact the Buyer and agree on the delivery time of the products and other issues related to delivery.
1.4. The Seller shall in all cases be released from liability for violation of the term of delivery of products, when this violation is committed due to circumstances beyond the control of the Seller.
